Life Science Series: Managing the Workforce - Update on Employee Misclassification

Many companies rely on independent contractors and consultants. This presentation will address both employment and benefits issues for companies using independent contractors , such as whether they should be classified as "employees." Employment overview includes: what constitutes an independent contractor versus employee, including affected industries and statutory definitions; joint employment exemption concerns; and determining exemption status for executive, administrative and professional levels. Benefits concerns include examining the potential risks and legal liability associated with misclassifying workers and failing to offer qualified (such as 401(k) ) and nonqualified (such as stock option) plans. We will also discuss the benefits of the new IRS Voluntary Correction Program for reclassification of workers as employees.
